The plan does not notice when the rest period is breached.
A late shift until 10 pm and an early shift from 6 am the next morning: eight hours of rest instead of the eleven required by section 5 ArbZG. The Working Time Act sets no deadline. For work on demand section 12 of the Part-Time and Fixed-Term Employment Act applies: the timing of the work must be communicated at least four days in advance, otherwise the employee does not have to work. Collective and works agreements often set longer notice periods.
At least eleven uninterrupted hours (section 5 (1) ArbZG). In hospitals, care facilities, restaurants, transport operations, broadcasting and agriculture it may be shortened to ten hours if every reduction is compensated within one calendar month or four weeks by an extension to at least twelve hours (section 5 (2) ArbZG).
If there is a works council: yes. The start and end of daily working time including breaks and the distribution of working time across the days of the week are subject to co-determination under section 87 (1) no. 2 BetrVG, and a temporary extension or reduction of working time under no. 3.
No. The plan says who should work; the record says who actually worked when. The duty from the Federal Labour Court decision of 13 September 2022 (1 ABR 22/21) relates to actual working time.
